PASCO COUNTY, FL – A video gamer said he was playing a game through an online multiplayer network when he heard his opponent commit a rape on June 28th. A Pasco man was arrested for the crime last week.
According to an affidavit, the gamer had been playing Grand Theft Auto with the suspect, identified as 18-year-old Daniel Enrique Fabian, of New Port Richey.
Fabien told the gamer there was a girl at his house, who he planned to “smash.”
The gamer told investigators Fabien stopped playing the game, but left his microphone on. During that time, the online player alleged that he could hear the victim yelling “no” and pleading with Fabian to stop.
According to the affidavit, obtained by ABC Action News, the victim told Fabian to stop at least four times, but he allegedly proceeded to have sexual intercourse with her.
After about 15 minutes, Fabian resumed playing the video game, according to reports.
The 15-year-old victim told detectives she was sitting on Fabian’s bed when he put his hand over her mouth to push her down and rape her.
She completed a SAVE (Sexual Assault Victim Exam), which supported her allegation of sexual abuse, the affidavit said. A DNA swab taken from her thigh linked Fabian to the crime.
Fabian was arrested for lewd and lascivious battery/sexual activity with a victim between the ages of 12 and 15.
News Channel 8 has learned that Fabian is also charged with raping another teen on June 4th, weeks before the most recent case..
“He was arrested in June for another case involving a different 15-year-old girl, where he allegedly raped her in his home as well,” said Kevin Doll, Pasco County Sheriff’s Office spokesman.
Fabian is being held at the Land O’ Lakes Detention Center.
