PASCO COUNTY, FL – A video gamer said he was playing a game through an online multiplayer network when he heard his opponent commit a rape on June 28th. A Pasco man was arrested for the crime last week.
According to an affidavit, the gamer had been playing Grand Theft Auto with the suspect, identified as 18-year-old Daniel Enrique Fabian, of New Port Richey.
Fabien told the gamer there was a girl at his house, who he planned to “smash.”
The gamer told investigators Fabien stopped playing the game, but left his microphone on. During that time, the online player alleged that he could hear the victim yelling “no” and pleading with Fabian to stop.
According to the affidavit, obtained by ABC Action News, the victim told Fabian to stop at least four times, but he allegedly proceeded to have sexual intercourse with her.
After about 15 minutes, Fabian resumed playing the video game, according to reports.
The 15-year-old victim told detectives she was sitting on Fabian’s bed when he put his hand over her mouth to push her down and rape her.
She completed a SAVE (Sexual Assault Victim Exam), which supported her allegation of sexual abuse, the affidavit said. A DNA swab taken from her thigh linked Fabian to the crime.
Fabian was arrested for lewd and lascivious battery/sexual activity with a victim between the ages of 12 and 15.
News Channel 8 has learned that Fabian is also charged with raping another teen on June 4th, weeks before the most recent case..
“He was arrested in June for another case involving a different 15-year-old girl, where he allegedly raped her in his home as well,” said Kevin Doll, Pasco County Sheriff’s Office spokesman.
Fabian is being held at the Land O’ Lakes Detention Center.
A man with a history of child sex crimes was recently bonded out of jail by his mother who had just won the $15.24 million Lotto Texas jackpot, according to the Dallas Morning News.
JoAnn Ames, 70, confirmed she posted 10% of her son’s $100,000 bond. Ames claims she and her husband Floyd Ames, 76, spent their life savings bailing him out of jail, but expect to collect their lottery winnings by the end of November.
The man, Jason Wayne Carlile, 47, previously has been convicted of exposing himself to a 2-year-old boy and spent three years in prison. Carlile was also convicted of paying a woman $3,000 in exchange for her 15-year-old daughter in 2006, according to the Wichita Times. In that case, Tina Valdez told police her daughter ran away, although she later admitted she sold her daughter to Carlile because she needed money. Valdez and Carlile were both sentenced to three years in prison. A child pornography charge was dropped during Carlile’s s plea deal. He was required to register as a sex offender annually until 2020.
U.S. marshals arrested him again in December 2017, accusing him of raping a child under 14..
Assistant Public Defender Rebecca Ruddy filed a motion to reconsider Carlile’s access to a public defender, saying he has access to money to hire a private defender because his mother won the lottery, bailed him out of jail and had discussed hiring a private lawyer with her son.
The winning ticket was bought at a Wichita Falls gas station Oct. 31, and the winners have 180 days to collect the cash value option, which they selected.
Carlile remains free on bond, on the conditions that he live with his mother, wear a GPS monitor and obey a 7 p.m.-10 a.m. curfew. His trial is set to begin in December.
SNOHOMISH COUNTY- Wash. A 20-year-old Washington state man was sentenced to less than three years in prison for raping a high school student as she died from a drug overdose in his bedroom.
Brian Varela admitted he gave 18-year-old Alyssa Noceda drugs last February, then raped her while she overdosed. He never tried to help her, but instead sent photos of her mostly nude body to his friends, mocking her as she lay there dying.
Varela told detectives that Noceda came to a party on Feb. 3 northeast of the Seattle suburb of Lynnwood. In Varela’s room, he said Noceda snorted Percocet and also ingested liquid marijuana, court documents said. Tests later showed she had taken a fatal mix of fentanyl and alprazolam, a generic name for Xanax.
She collapsed within a minute of mixing the two, Varela told detectives. Authorities said Varela never sought help for Noceda and instead sent semi-nude photos of her to friends and texting “LOL, I think she od’d, still breathing.”
Varela played an online game until he fell asleep, waking up in the morning to find Noceda’s lips blue, court documents said.
He went to work at Dairy Queen and his co-worker contacted police in the following days after Varela said he didn’t know if Noceda was still alive when he was having sex with her. Court records say he told a friend that “she died having sex with me.”
Police arrested Varela later that day after executing a search warrant and finding Noceda’s body in a plastic crate at the suspect’s home.
Varela told investigators he planned to bury Noceda with onions to minimize the odor. He also told detectives that after Noceda died, he used her thumb to unlock her phone Feb. 4 and send messages to make it appear she had run away.
Varela had pleaded guilty to second-degree manslaughter, third-degree rape, and unlawful disposal of remains as part of a plea deal.
Superior Court Judge Linda Krese said Thursday she could not sentence Brian Varela to more than 2 years and 10 months because it was the most prison time permitted for someone with no prior criminal record, The Daily Herald reported.
Krese said she was “surprised, even outraged,” by the inadequacy of the sentence and suggested that state lawmakers may not have realized the impact of their decision when they set prison sentences for the charges.
“I’m not sure the Legislature really contemplated something like this,” Krese said.
In court Thursday, Varela said only, “I’m sorry for my foolish actions. Whatever I get is what I deserve.”
Protests have taken place in Ireland after the underwear a teenager was wearing was cited in the trial of a man accused of raping her.
In the course of the trial, defense lawyer Elizabeth O’Connell held up a pair of the 17-year-old’s underwear in court, and asked: “You have to look at the way she was dressed. She was wearing a thong with a lace front.”
A 27-year-old man was found not guilty of raping the teenager earlier this month.
O’Connell’s comments, as reported by the Irish Examiner and others, provoked immediate criticism, with Dublin Rape Crisis Center calling for legal reforms over the remarks — but Rape Crisis said it was not questioning the verdict of the case.
“These kind of mythologies and stereotypes around rape come up again and again in court cases, because the defense to rape is that the sex was consensual,” Rape Crisis chief executive Noeline Blackwell told the Irish Independent newspaper. “So anything the defendant can do to suggest there was consent will be used.”
On Wednesday, women gathered at demonstrations across Ireland to protest the handling of the court case.
Their anger built on an online movement around #ThisIsNotConsent after the trial, kickstarted by the campaign group I Believe Her.
“Simply put, clothing is not consent. This kind of victim blaming is archaic and had no place in our court system,” Susan Dillon, who was among a group of women who started the hashtag, told BuzzFeed News via Twitter DM, from Ireland.
“We wanted something impactful that would draw attention to the issue hence the use of underwear.”
Dillon, 40, continued she was surprised at the wide response. “We knew people would be supportive and would want to support survivors of sexual violence but we have been overwhelmed by the response.”
In the days following the trial, hundreds of women tweeted images of their underwear, asking how attitudes around consent remained archaic and deeply problematic. Many of the women who tweeted about the case said that using the teenager’s underwear in court was “victim blaming.”
“We were trying to come up with ideas to express our anger,” the 39-year-old said, explaining she created the image after a discussion over the case in her painting class. Afterwards she made it public on her Facebook, and “it took off from there really along with the other women’s pictures!”
She added: “I’m a stay at home mum so I knew there wouldn’t be much chance to get to march in the protest…so I painted a pic instead!”
The message came through to the Dáil (the Irish House of Representatives) when politician Ruth Coppinger held up a pair of underwear in the chamber.
“It might seem embarrassing to show a pair of thongs here,” Coppinger said. “How do you think a rape victim or a woman feels at the incongruous setting of her underwear being shown in a court?”
A Waco woman wanted by Robinson police on charges that she got a 14-year-old boy drunk and sexually assaulted him turned herself in Wednesday.
Stephanie Olivarez, 32, was booked at McLennan County Jail on a first-degree felony charge of aggravated sexual assault of a minor and four Class A misdemeanor charges of furnishing alcohol to a minor.
Robinson police said they were searching for Olivarez on Tuesday, after they arrested a Tricia Dawn Volpe, 41, also of Robinson, in a related case involving the sexual assault of another 14-year-old boy.
The two women gave liquor to the two 14-year-old boys and other underage friends in January, police said. Volpe is accused of having sex with one of the boys at that time. Olivarez is accused of having sex with the other boy after an April gathering at her house, in which she got the boy drunk along with two of his 13-year-old friends.

The second tier has it’s nuances and subtle difference from Jason Black to Tariq Nasheed to Boyce Watkins and of course the most interesting and staunchly conservative of them, Gus T Renegade. Which is obviously not his real name which one can assume creates an alluring mystery to a true believing follower of his. That moniker actually comes from the Klan propaganda film “Birth Of A Nation”. in that film, character accused of raping a white woman was named “Gus The Renegade Negro”. So… Very Clever.
These figure heads and their loyal followers are sorely displeased that Bill Cosby went to prison for being a rapist. As they are conservatives, preferred narrative trumps facts. Arbitrarily assigned correlation trumps a traceable series of chronologically separable events and stories.

Patton Oswalt was on the You Made It Weird podcast with Pete Holmes and actually made it weird for a minute. That’s because the topic of Bill Cosby came up during the chat and Oswalt had some very strong, but noteworthy opinions on the situation.
The comedian hasn’t shied away from letting his feelings known about the Cosby sexual assault allegations, but the detail he goes into during the podcast really drive the message home: This probably is going to get worse.
They don’t care that he paid over 3 million to make the case go away in 2006 as documented in outlets such as The Guardian.

They don’t care that #metoo is actually from 2007 but gained little to no traction.
Or that it wasn’t until a decade later in 2017 when it did pick up as covered in outlets like Ebony.com and DemocracyNow.Org.
They don’t care that it was shaky video from an amateur filmography with a smart device uploaded in 2013 that actually bought awareness to Cosby being a rapist.
That there was no #metoo conversation, let alone a movement.
They don’t care that fellow comedian, Hannibal Buress of whom actually has a joke of which rhetorically opposes feminism, is the one that took to the stage that evening.
They also don’t care why.
That younger performers since the 80’s had trouble with him trying to control them and make them not use dirty, evil curse words going back to Eddie Murphy. That before Buress started saying that on stage, Cosby was a guest with fellow comedian, John Stewart and was telling him that the only reason people laughed was because of his dirty language.
They don’t care that Cosby’s story is parallel to and clearly not a part of #MeToo.
They want it to be because this strain of black conservative actually doesn’t like white supremacy. Further; They want it to be a part of #MeToo because as conservatives, they don’t believe victims by default. As conservatives, they just oppose anything associated with the word “feminist” by default.
One is probably not surprised that these folks are also conspiracy minded and when you mix that with being highly conservative AND against white supremacy, it gets a little weird.

Neely Fuller Jr has a book out and does audio clips with the pausing and pacing of a comedian. Frances Welsing, even in death is still one of the most referenced for her popular pseudoscience and creatively colorful ideas about sexuality. They actually call The Grancestor.

Her idea is that white people eat chocolate bars to simulate fellating and even consuming a black mans penis.
She furthers it with the idea that there are chocolate bars with nuts in them to represent the testicles.
She goes even further and points to Valentines Day and postulates that white people to celebrate romance, they give each other imaginary black penises and testicles because of their obsession with black penises.
That’s right. Fans of her and this whole ideological crowd are out there.

A North Carolina Domino’s employee was fired after a customer came to pick up her order and saw a racial slur on the order board in place of her name.
Myasia Nelson told WFMY that she placed a carry-out order for two pizzas and a side of wings at a Domino’s in Burlington, North Carolina, on Monday night. When she was waiting for the food to be ready, she noticed on the order board that instead of her name, the n-word, spelled “NIGA,” was displayed.
The employee, who has not been named, told his supervisor, Junior Snyder, that there was no ill intent in the word he chose. He claimed that he simply couldn’t understand what she was saying. Snyder explained that the employee recounted the story to him and since he didn’t know how to spell her name, he just typed anything in to the order system.
However, Nelson wasn’t convinced it was a simple mistake. She claimed she was only asked to give her name once and Myasia, which is the name she gave the employee for the order, sounds nothing like the word he chose.
“Racial discrimination. That’s what I feel like it is because if it were anyone else they would have never done that,” Nelson told WFMY.
By Tuesday, Snyder had fired the employee because regardless of whether the incident was a mistake, he explained to WFMY that what happened doesn’t reflect the company’s values.
“You can’t work for your company,” Snyder said he told the employee. “We’re not like that.”

Although the Burlington Domino’s is an independent franchise, corporate fully supported Snyder’s decision to fire the employee and commended him for doing it immediately after he was made aware of what transpired.
“As you might expect, this behavior is repulsive and intolerable and has no place in our brand,” Domino’s told Newsweek. “There are more than 15,000 Domino’s units in 90 countries around the world – we are a diverse, inclusive brand and there is no tolerance for that behavior.”
Snyder apologized to Nelson and he explained to WFMY that moving forward, all he can do is ensure it doesn’t happen again, train employees and “make sure everyone understands we don’t tolerate this.”
Aside from the anger that Nelson felt on behalf of herself, the experience took on a deeper meaning when she viewed it through the lens of being a mother.
“I don’t want my daughter growing up being called the words that they wrote about me or being called any type of name,” she told WFMY.
Domino’s also offered Nelson a $50 gift card, but she refused it on the basis that $50 is not worth what she had to endure.
The mother of a former eighth-grade student has filed a $300,000 lawsuit against Portland Public Schools, claiming a substitute teacher whacked the boy on the head with a clipboard and called him the n-word.
Lamar Warren is African American and was a 13-year-old student at Martin Luther King Jr. School at the time of the alleged assault in October 2017, according to the lawsuit filed last week in Multnomah County Circuit Court.

A campaign sign in Central Texas this week drew the scorn of an elected state official — and then it was confiscated by police.
At issue in the small community of Hamilton was a homemade yard sign featuring an elephant decorated in red, white and blue with its trunk up the skirt of a female saying the word “Help.” The sign said “Your vote matters.”
Other signs promoting Democrats from U.S. Senate candidate Beto O’Rourke to Agriculture Commissioner candidate Kim Olson were in the background.
